NUMEROSITY, COMMONALITY, TYPICALITY, AND ADEQUATE REPRESENTATION:  Thousands of Bar exam takers across America were unable to upload their essay responses yesterday because, I guess, no one at ExamSoft realized that everyone would be trying to use their site on the same day. Please list all possible tort and other causes of action from what's being referred to on the Twitters as #Barghazi and #Barmageddon.

    I've been twitching ever since I read about this last night. I cannot even begin to imagine what a basket case I would have been.

  2. Of course, we had the freak out when I took the NY bar that one of the essays dealt with an issue (priority of executors) that wasn't covered in the Big Book of BARBRI (much less in the BARBRI lectures). We actually got an apology letter from BARBRI. A lot of people just freaked.

    While I probably should have been more freaked out by the essays, my heart attack moment during the bar was a massive bird landing on my table mid-session (Maryland's overflow site for non-residents was at an equestrian center).

  4. Everyone needs to give ExamSoft a break, it's not like they could have possibly anticipated that everyone would be trying to upload their exams all at once...


    Honestly, given what a crappy system it is, I'm a bit surprised this hasn't happened before.

    Not least because their solution to the upload problem was "well, upload it tomorrow night after you get done with the MBE." I assume most of the bar-taking universe had rather intended to get shitfaced tonight, not deal with technical issues.

  8. We will be happy to settle the class action with a $20 coupon good for your next bar exam. (Which is how BarBRI tried to settle a recent class action.)

    This is actually the first time I had heard that essay responses are uploaded now instead of handwritten. How long has that been true? I took the bar 20 years ago, and while I've had friends study for it since, they didn't mention that it was computerized.


    In law school, do you still handwrite essays in bluebooks, or are exams computerized there too now?
